Introduction
These Terms apply to custom Skalp360 hair systems ordered by Skalp360 Certified Specialists (“Specialist”) through the Skalp360 Partner Ordering Portal. By placing an order, the Specialist agrees to these Terms.
1. WHO MAY ORDER
Portal is for authorised Skalp360 Certified Specialists. Access, Partner Pricing and ordering process are personal to authorised Specialist/business and must not be shared. Skalp360 may reasonably suspend access for certification failure, material breach or misuse.
2. CUSTOM-MANUFACTURED PRODUCT
Every system is individually manufactured from submitted client specifications including cast, measurements, size, length, colour/placement, texture, Skalp colour, base, density, hairline/design, photos and instructions. Once production has commenced, orders cannot ordinarily be cancelled, changed or refunded for change of mind, including client change of mind, failure to attend or change in client relationship. Preserve non-excludable rights.
3. CLIENT CONSULTATION AND APPROVAL
Before ordering, Specialist completes consultation, confirms specifications and obtains signed Skalp360 Client Custom System Agreement & Order Approval. By ordering, Specialist confirms client approval, signed agreement, submitted specs match approval, and custom nature, estimated timeframes, human-hair, maintenance and aftercare expectations were explained. Skalp360 is not responsible for specialist-client disputes caused by failure to obtain approval/miscommunication/spec mismatch except where legally responsible.
4. ORDER ACCURACY — SPECIALIST RESPONSIBILITY
Specialist must check client details, cast/measurements, size, markings/boundaries, hairline/design, length, colour/placement, texture, Skalp colour, base, density, photos and notes. Manufacture relies on submitted information. A system substantially manufactured to submitted specs is not faulty merely because Specialist/client later prefers another specification. Incorrect/incomplete Specialist info causing correction/remake may incur cost. Preserve non-excludable rights.
5. CASTS, MEASUREMENTS AND MARKINGS
Specialist prepares cast according to Skalp360 training; measurements, hairline, boundaries, orientation and markings must be clear/accurate. Completed cast photo is required for preliminary review only and does not verify/guarantee physical dimensions, fit or accuracy. Physical cast may be assessed. If physical cast is larger than purchased size, manufacture pauses until correct size confirmed and price difference paid. Unclear/incomplete/inconsistent cast may be held for clarification/replacement. Waiting time is excluded from manufacturing estimate.
6. CAST SHIPPING AND TRANSIT
Specialist securely packages/sends cast per instructions. Skalp360 cannot guarantee third-party carrier handling. Lost/crushed/distorted/damaged/unsuitable casts may require recast. Specialist bears recast/additional shipping except where Skalp360 is legally responsible. Manufacture cannot commence until suitable cast and required information received.
7. COLOUR, HUMAN HAIR AND FINISHING
Human hair is natural and batch variation can occur. Matching/blending is done as closely as reasonably possible from submitted references. Manufacturing is not equivalent to an in-salon colour service; minor tonal/dimensional/finishing adjustment may be required by Certified Specialist. Reasonable variation/minor professional adjustment alone is not a manufacturing fault. Incorrect colour instructions supplied by Specialist make resulting correction/remake Specialist responsibility, subject to law.
8. PRICE AND PAYMENT
Portal price applies to selected specs subject to legally correctable error. Extra charges may arise if physical cast/specs exceed purchased size/length/configuration. Manufacture may be held until payment. Shipping/taxes/charges applied as relevant.
9. MANUFACTURING TIMEFRAME
Current estimated manufacturing timeframe: 12–16 weeks for ALL custom Skalp360 systems. Estimate, not guaranteed completion/dispatch/delivery/fitting date. Starts only when factory has suitable physical cast where required, complete/clear specs, required photos/info and outstanding payment. 12–16 weeks excludes shipping. Current allowance: approx. 1 week cast transit to factory + 12–16 weeks manufacture + approx. 1 week completed system transit to Specialist. Shipping estimates vary.
10. DELAYS
Custom manufacture can take longer. Causes include complexity, hair/material availability, clarification, factory workload, additional work, QC, repairs/corrections/remanufacture, freight, customs, courier disruption or circumstances outside reasonable control. Skalp360 provides material updates when available. Specialist must not guarantee fitting date based solely on estimate; client should not make non-refundable/time-sensitive arrangements based on estimated arrival. Reasonable custom manufacturing/delivery delay does not automatically create cancellation right, subject to law.
11. QUALITY CONTROL
Systems are checked against submitted specs/quality standards. If not passed, adjustment, repair, correction or remanufacture may occur before supply and extend estimate. Additional QC does not itself mean order abandoned or create automatic cancellation right.
12. HUMAN HAIR, WEAR AND LIFESPAN
Wearable human-hair product. Hair changes through use: shedding, dryness, fading/colour change, tangling, matting, reduced softness and deterioration may occur. Longevity affected by wear/sleeping, washing/drying, brushing, maintenance, adhesives/removers, heat, colouring/chemicals, swimming/chlorine/salt, exercise/perspiration, environment and products. Specific lifespan cannot be guaranteed. Normal wear/natural characteristics alone are not evidence of manufacturing fault.
13. PRODUCTS, HEAT, COLOURING AND CHEMICAL ALTERATION
Excess/repeated hairspray, root sprays, coloured root sprays, dry shampoo and styling build-up may cause dryness, tangling, matting, discolouration, base deterioration or shedding. Excessive dryer/straightener/curling heat may damage hair/base. Colouring, toning, lightening and chemical processing affect condition/longevity. Damage caused by inappropriate products, excessive heat, chemical processing, incorrect washing/drying, poor maintenance, misuse or failure to follow aftercare is not a manufacturing fault to the extent it caused the issue.
14. THREE-MONTH SKALP360 VOLUNTARY MANUFACTURING-FAULT POLICY
Additional voluntary policy for 3 months from Specialist receipt. Suspected manufacturing fault: contact orders@skalp360.com with order details and requested photos/video/information. Physical return may be required. Specialist initially pays reasonable assessment return cost. If covered manufacturing fault confirmed, Skalp360 reimburses reasonable assessment-return postage and provides remedy under voluntary policy. Confirmed repairable manufacturing fault ordinarily repaired at no charge. If cannot reasonably be repaired, Skalp360 determines appropriate alternative remedy under voluntary policy, potentially replacement. Policy is additional to and does not exclude/restrict/modify non-excludable rights.
15. SHEDDING AND FACTORY REPAIR SUPPORT
Shedding can occur normally and is not automatically a manufacturing defect. Unusual/excessive shedding may require evidence/return. In some circumstances factory may provide reinjection/repair support during approximately first six months. This is assessment-based, not an unconditional six-month guarantee. Availability/charges depend on condition, extent, cause and factory assessment. Substantial reinjection/repairs may incur charge. Legal rights unaffected.
16. FAULT ASSESSMENT
Fault report does not itself establish defect. Skalp360 must have reasonable assessment opportunity. May consider photos/video, order specs, age, wear, maintenance, products, heat/chemical exposure, alterations, third-party work, base/hair condition and physical system. Assessment distinguishes manufacturing issue from normal wear, aftercare damage, alteration, misuse or external cause where reasonably possible.
17. ALTERATIONS AND THIRD-PARTY WORK
Specialist uses professional judgment fitting, colouring, altering and maintaining system. Skalp360 is not responsible for damage caused/contributed to by post-manufacture work including inappropriate cutting, colouring, bleaching, chemicals, base alteration, excessive heat, inappropriate adhesive/remover or third-party work. Preserve non-excludable liability.
18. COSMETIC PRODUCT — NOT MEDICAL TREATMENT
Skalp360 is a cosmetic custom-manufactured hair-replacement product, not represented/supplied as medical device, medical-grade product or hair-loss treatment; does not diagnose/treat/cure/prevent medical/scalp conditions. Specialists must not make medical claims. Refer concerns outside scope to appropriately qualified health professional.
19. SPECIALIST PROFESSIONAL RESPONSIBILITY
Training/supply does not replace Specialist responsibility to client. Specialist remains responsible for consultation, suitability within scope, client communication, fitting, cutting, colouring/finishing, maintenance, aftercare and client relationship. No guarantees inconsistent with current Skalp360 education/docs/Terms.
20. SPECIALIST–CLIENT RELATIONSHIP
Unless agreed otherwise, Skalp360 is not party to separate salon/service agreement between Specialist and client. Client dispute does not automatically cancel manufacturing order. Specialist manages client relationship; Skalp360 remains responsible for its own product obligations.
21. FACTORY RELATIONSHIP AND NON-CIRCUMVENTION
Skalp360 manufacturing network, factory relationships, sourcing, ordering processes, contacts and related commercial information are confidential. Specialists use authorised Skalp360 pathway and must not use confidential Skalp360 information to bypass Skalp360 and order directly from/solicit/establish unauthorised direct supply with Skalp360 manufacturing partner. Intended to protect confidential commercial relationships and does not restrict conduct that cannot lawfully be restricted.
22. SKALP360 INTELLECTUAL PROPERTY AND BRANDING
Portal/purchase access does not transfer ownership of Skalp360 brand, training, methods, documentation, photography, forms, ordering systems or IP. Branding use remains subject to separate certification/brand terms. These Terms do not replace Skalp360 Brand & Certification Agreement.
23. AUSTRALIAN CONSUMER LAW AND OTHER RIGHTS
Nothing intended to exclude/restrict/modify a guarantee, condition, warranty, right or remedy that cannot lawfully be excluded/restricted/modified. Whether particular ACL consumer guarantees apply to Partner order can depend on nature/purpose of acquisition. These Terms do not represent statutory guarantees always or never apply. Where applicable they operate in addition to these Terms and voluntary policy.
24. ELECTRONIC ACCEPTANCE
Electronic acceptance when ordering forms part of order record. Skalp360 may retain order specs, uploads, confirmations, Terms acceptance, payment and related communications.
25. GOVERNING LAW
Governed by laws applicable in Western Australia, Australia, subject to mandatory law. Parties submit to courts/tribunals with jurisdiction in WA subject to applicable law.
